Henry Solano advises clients on the
broad range of labor and employment laws covering the full range of personnel
matters, policies and practices including those related to anti-discrimination,
wage and hour, occupational safety and health, employment agreements including
restrictive covenants and confidentiality provisions, terminations,
whistleblower protections, collective bargaining, and ERISA coverage and
claims. He regularly participates in the due diligence review and advice
concerning labor, employment and ERISA matters in merger and acquisition
(M&A) transactions. Mr. Solano supports this advice through litigation
representation on labor and employment matters, where he has appeared in
numerous state and federal jurisdictions. He has successfully defended clients
in class action wage hour and ERISA matters, not only at the trial court level,
but the appellate level.
Mr. Solano joined Dewey & LeBoeuf after serving as the Solicitor of Labor for the
U.S. Department of Labor (DOL) and, for a brief time, the Acting Secretary
of Labor. In his role at the DOL, Mr. Solano provided legal and policy advice
to the Secretary and senior department officials, conducted internal
investigations of misconduct by Senior Executives of DOL, and oversaw all legal
enforcement actions taken pursuant to approximately 150 statutes protecting
worker security and establishing workplace safety including the Occupational
Safety and Health Act, Mine Safety and Health Act, Fair Labor Standards Act,
Family Medical Leave Act, Employee Retirement Income Security Act and the
Executive Order on Anti-Discrimination.
In the beginning of his career, Mr.
Solano had also served as the Assistant Attorney General and the Assistant U.S.
Attorney for the State of Colorado. During the late 80's, he was the Director
for the Regional Transportation District (District C) and the Executive
Director for both the Colorado Department of Regulatory Agencies and the
Colorado Department of Institutions. For a brief period from 1989-90, Mr.
Solano was the Acting Executive Director for the Colorado Department of
Corrections. Before assuming his post as the Solicitor of Labor, Mr. Solano was
the U.S. Attorney for the State of Colorado.

The ultimate power lunch: Steve Farber and Norm Brownstein
have come a long way since the two west Denver boys partnered up in a law firm
that would, three decades later, be renowned for its influence that not only
smothers Denver but stretches right across the country. On Thursday the folks
of Brownstein, Hyatt, Farber &
Strickland and 500 of their nearest and dearest friends will gather at a
luncheon to commemorate The Firm's thirtieth anniversary (which actually was
last October) and announce the establishment of minority scholarships at the
University of Colorado law school (which both Farber and Brownstein attended)
and the University of Denver law school (the alma mater of other lawyers in the
firm and one of Farber's many board posts). "You have some successes, and you
want to give back to the community," Farber says. "Thirty years of
law practice--most guys my age have already retired."
But these guys are far from shy and
retiring. And the real coup--and sign of the firm's prestige--came on Monday,
when the U.S. Senate confirmed the appointment of partner and 1996 Senate
candidate Tom Strickland as U.S. Attorney for Colorado. Strickland, who was
nominated by President Bill
Clinton back in January, replaces Henry Solano, who's now with the U.S. Labor Department.
(Another notable Labor employee: regional head and Denver First Lady Wilma
Webb.)
Anyone who's anyone knows The Firm's
partners, as evidenced when Farber returned a call via his cell phone just as
he was going through a metal detector Tuesday. Flying out of DIA for an overseas celebration? No, just heading into the
Denver City & County Building for more business as usual, including a
meeting and lots of casual schmoozing--complete with greetings from councilmembers Susan Barnes-Gelt and Sue Casey heard by a nosy reporter (who will not be at the luncheon)
as the cell phone went through the X-ray machine.

Dem bones: Henry Solano, Colorado's U.S. Attorney and a former Roy Romer
cabinet member, may be headed for Washington. He's been nominated as the
Department of Labor's next solicitor general, the agency's No. 3 job, which
would put him in charge of hundreds of lawyers.
If his nomination is confirmed by
the Senate, perhaps Solano's first act (after
removing all that silver-and-turquoise jewelry, that is; even Ben Nighthorse Campbell
has toned down his Southwestern look) should be to clarify the guidelines
governing federal bureaucrats' political activities. Earlier this month a
fellow Coloradan-cum-Labor appointee, regional director Wilma Webb, had a starring role at a $250-per-person "Webb for
Mayor" fundraiser. But even though Wilma's married to Wellington Webb,
who may or may not be running for a third term as mayor, and even though the
invite used her "First Lady" honorarium rather than her federal
title, her participation was a technical violation of her own agency's rules.
The host of the posh Cherry Hills event, Morris Clark,
knows all about bending labor rules. Under the city's minority contracting
program, he owns a stake in the Colorado Parking Company, which provides
parking services at Denver International Airport and has come under attack from its employees, many of them
minorities themselves, for poor working conditions. Among their complaints:
Clark, a dentist, didn't provide dental insurance. In fact, in the spring of
1995, a union-organizing drive became so contentious that the feds got
involved--and weighed in against Clark and company.
